5. Acceptable Website Use

(a) Specific Prohibited Uses

AquaRegia HR website may be used only for lawful purposes by individuals seeking employment and employers seeking employees. AquaRegia HR specifically prohibits any use of this website, and requires all users to agree not to use this website, for any of the following:

(i) Do Not post to Resume Builder any incomplete, false or inaccurate resume information or information which is not your own accurate resume (living individual seeking employment on a full-time or part-time basis on his or her own behalf). Do not post non-resume information such as opinions or notices, commercial or otherwise. Headhunters, employment placement/outplacement agencies, temporary worker agencies, consultants and other third parties, including any third party charging a fee or restricting complete access to all resume information, are prohibited.

(ii) Do Not respond to any employment opportunity on the JOBS Database for any reason except to apply for the job. Communications soliciting the employer's business by our competitors are prohibited.

(iii) Do Not post to Resume Database or the JOBS Database any franchise, pyramid scheme, "club membership", distributorship or sales representative agency arrangement or other business opportunity which requires an up front or periodic payment, pays commissions only (no significant salary), requires recruitment of other members, sub-distributors or sub-agents.

(iv) Do Not delete or revise any material posted by any other person or entity.

(v) Do Not print out or otherwise copy or use any personally identifiable information about employees or business information about employers. Unsolicited e-mail, telephone calls, mailings or other contacts to posting individuals and companies are prohibited.

(vi) Do Not post any material that -

(1) is defamatory, libelous, obscene, indecent, abusive or threatening to others;
(2) infringes the copyright, trademark or other right of any third party;
(3) uploads viruses or other contaminating or destructive features;
(4) is commercial in nature; or
(5) is in violation of any applicable laws or regulations.

This Agreement shall be governed by and construed in accordance with the laws of the State of Karnataka, as applied to contracts entered into and performed within Karnataka, India. Disputes concerning this website or this Agreement will at the election of either party be resolved exclusively through binding arbitration conducted in accordance with Commercial Arbitration Rules. Arbitration will be conducted in Bangalore, Karnataka, India before a single arbitrator selected in accordance with such Rules. The arbitrator's decision will be non-appeal able and judgment thereon may be entered in any court with jurisdiction over the parties. The foregoing notwithstanding, nothing in this Agreement will be deemed to preclude any party from using the legal process of any court with jurisdiction to seek remedy or redress (including without limitation injunctive or other equitable relief) for any infringement of copyright, trademark rights, or other intellectual property rights.
